Terms of Service

The rules that govern your use of opnWork! Please read these carefully.

1. Acceptance of Terms

By accessing or using opnWork! ("the Platform"), operated by opnWork Technologies, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Platform.

2. Description of Service

opnWork! is an online marketplace that connects applicants with employers for local, hourly, and entry-level employment opportunities. We provide a platform for posting and discovering jobs, submitting applications, and facilitating communication between parties.

opnWork! does not act as an employer, staffing agency, or employment service. We do not guarantee employment outcomes, wage accuracy, or working conditions for any listing posted on the Platform.

3. Account Registration

To use certain features, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 16 years old to create an account. Users under 18 may have restricted access to certain features in accordance with local labor laws.

4. User Conduct

You agree not to use the Platform to:

  • Post false, misleading, or fraudulent job listings or profile information
  • Harass, abuse, or threaten other users
  • Violate any applicable local, state, national, or international law
  • Discriminate against applicants based on protected characteristics
  • Send unsolicited commercial messages or spam
  • Attempt to gain unauthorized access to the Platform or other accounts
  • Interfere with or disrupt the Platform's operation
  • Scrape, data-mine, or use automated tools to extract content

5. Job Listings (Employers)

Employers who post job listings agree to:

  • Provide accurate job descriptions, wages, locations, and requirements
  • Comply with all applicable employment laws and regulations
  • Not charge applicants any fees for applying or being considered
  • Respond to applicants in a timely and professional manner
  • Maintain valid business licenses and insurance where required
  • Pay all employees through lawful payroll channels, including proper tax withholding and reporting
  • Not offer or facilitate "cash-in-hand," "under-the-table," or off-the-books employment arrangements

We reserve the right to remove any listing that violates these Terms, appears fraudulent, or is reported by users without prior notice.

6. Applications (Applicants)

Applicants who apply for positions agree to:

  • Provide truthful information in their profiles and applications
  • Only apply for positions they are genuinely interested in
  • Respect employer communication preferences and response times
  • Not misrepresent qualifications, experience, or work authorization

7. Work Authorization & Legal Compliance

All users of the Platform must comply with the employment and immigration laws of the country in which they seek or offer employment. By using opnWork!, you represent and warrant that:

  • You hold a valid legal right to work in the jurisdiction where the position is located, including any required work permits, visas, or employment authorizations
  • You will not accept or perform work that exceeds the conditions of your visa, work permit, or immigration status
  • You will not use the Platform to seek, offer, or facilitate employment that violates any applicable labor, tax, or immigration law
  • If you are an international student, you understand and will comply with the work-hour restrictions imposed by your student visa or study permit (see below)

Note: opnWork! does not verify immigration status or work authorization. It is your sole responsibility to ensure that you are legally permitted to work before accepting any position.

8. International Student Employment Rules

If you are an international student, you are subject to strict work-hour limits and conditions imposed by your host country's immigration laws. The following table provides general guidance only.

Immigration policies change frequently. Always verify your work entitlements through your host country's official government website or university international student office.

9. Prohibition of Cash & Unlawful Employment

opnWork! strictly prohibits the use of the Platform to facilitate, advertise, seek, or arrange any form of unlawful employment, including but not limited to:

  • "Cash-in-hand" or "under-the-table" work — payments in cash to avoid payroll taxes or statutory obligations
  • Off-the-books employment — work without proper contracts, payslips, or tax reporting
  • Visa-violating employment — work that exceeds visa-permitted hours or conditions
  • Exploitative labor practices — paying below minimum wage, withholding wages, or requiring workers to forgo legal rights

For Employers: You must pay all workers through lawful payroll channels, provide proper employment documentation, and comply with all local minimum wage and labor laws.

For Applicants: If you are offered a "cash-only" position or asked to work without a proper contract, decline and report the listing. Working illegally provides no legal protections.

10. Content & Intellectual Property

You retain ownership of any content you submit to the Platform. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content in connection with operating the Platform.

The opnWork! name, logo, design, and related trademarks are the property of opnWork Technologies, Inc. You may not use our trademarks without prior written permission.

11. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Limitation of Liability

To the maximum extent permitted by law, opnWork Technologies, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with the Platform.

We are not responsible for the actions, content, or accuracy of third parties, including employers and applicants who use the Platform.

13. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

14. Termination

We may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Platform will immediately cease.

15. Modifications to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or platform notification. Your continued use of the Platform after changes constitutes acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
